These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of Nigerian courts.

2. Accounts

To access certain features of our website, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that contain inaccurate or fraudulent information.

You must notify us immediately of any unauthorised use of your account or any other breach of security. Blemish Care shall not be liable for any loss arising from your failure to safeguard your account credentials.

3. Orders & Products

All orders placed through our website are subject to product availability and acceptance by Blemish Care. We reserve the right to refuse or cancel any order for any reason, including but not limited to pricing errors, suspected fraud, or product unavailability.

Product descriptions, images, and specifications are provided for informational purposes. While we strive for accuracy, actual product colours and appearance may vary slightly due to screen display differences and photography.

By placing an order, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian. Blemish Care products are intended for external cosmetic use only and should be used as directed.

4. Payments & Pricing

All prices on our website are displayed in Nigerian Naira (₦) and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without prior notice. Prices applicable to your order are those displayed at the time of purchase.

Payment must be completed at the time of placing an order through our accepted payment methods, which include Paystack (card payments, bank transfer, USSD), and Pay on Delivery (available for Lagos orders only).

Promotional offers, discount codes, and special pricing are subject to specific terms and conditions and may be withdrawn or modified at our discretion. Promotional codes cannot be combined unless explicitly stated.

5. Shipping

Delivery timelines provided on our website and in order confirmations are estimates and not guarantees. Blemish Care is not liable for delays caused by shipping carriers, customs, or unforeseen circumstances such as adverse weather or public holidays.

Risk of loss and title for products pass to you upon delivery to the shipping carrier. Please refer to our Shipping Policy for detailed information on delivery zones, rates, and timeframes.

6. Returns & Refunds

We accept returns of unopened and unused products within 30 days of delivery. Products must be in their original packaging and in the same condition as received. Opened products cannot be returned for hygiene reasons, unless they are defective.

Refunds for approved returns are processed within 5-7 business days to the original payment method. Return shipping costs are the responsibility of the customer unless the return is due to a defective or incorrect product.

7. Intellectual Property

All content on the Blemish Care website, including but not limited to text, images, graphics, logos, icons, audio, video, software, and design elements, is the property of Blemish Care Cosmetics and is protected by Nigerian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without prior written consent from Blemish Care. Unauthorised use may result in legal action.

8. Limitation of Liability

To the fullest extent permitted by Nigerian law, Blemish Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our products, website, or services.

Our total aggregate liability for any claim arising under these terms shall not exceed the total amount paid by you for the specific product or transaction in question. This limitation applies regardless of the legal theory upon which the claim is based.

Blemish Care makes no warranties, expressed or implied, regarding the suitability of our products for any specific skin condition. Users are advised to perform a patch test before using any new product and to consult a dermatologist if they have specific skin concerns.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy, in compliance with the Nigeria Data Protection Regulation (NDPR) and applicable data protection laws.
